My understanding has always been that a flat right fee for a license is not the same as art for hire. By this I mean a flat rate fee is a licensing contract where you retain the copyright, correct? An art for hire contract is where you do get paid and flat fee but you also are selling your copyright? Is my thinking correct on this?
So, if you tell a manufacturer that you will work with a flat fee then you are still licensing because your ar not selling your copyright along with a fee ? i seem to hear the term flat fee tossed around when they are really referring to and art for hire situation. Can you clarify?
